My wife was fired from her job and was given no warning.  Is this legal?

    That would depend on the reason she was fired, but more than likely, yes. 

    The courts of Missouri follow an Employment-At-Will” doctrine.  This means that both the employee and employer can end the employment relationship at any time and for any reason, as long as it is not discrimination under the Civil Rights Act.  Unless there is a written employment agreement, an employer may dictate or change the terms and conditions of employment.  The employee can either agree to the terms and conditions, or refuse them  and risk termination.  The exact laws can be found in Chapter 290 RSMo. and Regulations (Rules) under 8CSR 30, 4.010-050. – Missouri Division of Labor Standards  



My employer canceled my health insurance – can they do that?

    Yes (provided you are not a contracted employee whose benefits and wages are discussed in said contract). The courts of Missouri follow an Employment-At-Will” doctrine.  This means that both the employee and employer can end the employment relationship at any time and for any reason, as long as it is not discrimination under the Civil Rights Act.  Unless there is a written employment agreement, an employer may dictate or change the terms and conditions of employment.  The employee can either agree to the terms and conditions, or refuse them  and risk termination.  The exact laws can be found in Chapter 290 RSMo. and Regulations (Rules) under 8CSR 30, 4.010-050. – Missouri Division of Labor Standards  

 


My ex-husband isn't following the parenting plan from our divorce.  What can I do?

    Contact your former divorce attorney and ask them to address the issue with the Court.  The parenting plan is the governing document and is a Court order – you could be held in contempt of Court for failure to comply with the Order.  

 


My wife had a heart attack while taking Avandia.  What can I do?

Contact her physician for instructions, then please call our office.

 


 

I am taking YAZ and had to have my gallbladder removed.  I've heard there may be a class action suit.  Can you help me?

      YAZ has been linked to gallbladder disease.  Many factors go in to determining  whether or not you are eligible to participate in a class action suit of this nature.

My wife had a stroke while taking YAZ.  Could YAZ have caused it and if so, can I sue their manufacturer?

      YAZ has been linked to stroke, however, many factors go in to determining  whether or not YAZ was the actual cause of your wife's stroke.  Please give us a  call to schedule an appointment to come in and meet. 

 


My daughter became very ill and tests show that she has blood clots in her lungs.   The only medicine she takes is YAZ.  Can you help us?

      YAZ has been known to cause blood clots, however, many factors go in to  determining whether or not YAZ was the actual cause of your daughter's blood  clots.   Please give us a call to schedule an appointment to come in and meet. 

 


I had a car wreck and the other driver has no insurance.  What now?

      Every person who has insurance has un-insured motorist coverage.  We  recommend contacting your insurance company for more information on how  to proceed. 

 


 

I was rear-ended and the other driver's insurance company is telling me it's partly my fault.  What should I do?

    If you are unhappy with the amount of compensation they are offering you, we recommend contacting an attorney.  Filing suit may be an option. 

 


I just received a letter saying my medicine was recalled by the company that made it.  Can you help me?

    Stop taking the medication and contact your physician.  Be sure to KEEP all unused portions of the medicine along with the letter that you received from the manufacturer.  If you have suffered any injury or illness because of this medication, please contact our office immediately. 

     


 

My husband was killed in a car accident while he was on the job.  Is this a work comp claim or can I sue the driver who hit him?

    It may be covered by workers' compensation, you may have a claim against a third-party, or both – please give us a call and we'll see if we can help. 

     


I had a car accident.  The other driver's insurance company wants to see my medical records.  Should I let them?

    The insurance company is entitled to evaluate the claim; so providing them with records from the accident is appropriate.  Allowing them the ability to receive any and all medical records from before the accident is likely inappropriate. 

 


My teenage son caused a car wreck and the other person is hurt.  Can the person he hit sue me?

    You are not responsible for the negligence of others – including your son – unless they can show that you were negligent in entrusting him with a vehicle.   

 


The pharmacy just called and told me that my daughter's medication is filled wrong!  My daughter has been very sick but we didn't know why.  The pharmacy wants us to bring the medicine back.  What should we do?

    Stop taking the medication and contact your physician.  Be sure to KEEP all unused portions of the medicine along with the letter that you received from the pharmacy.  Please contact our office immediately. 

 


I'm involved in a class action lawsuit and it's taking forever to get my money.  Supposedly, it was settled a long time ago.  Is this normal?

      Yes.  Many times class action settlements take a very long time to wrap up due to  the vast numbers of people entitled to benefits from the settlement.  Be patient. 

 


My son was killed two years ago and we never filed suit.  Is it too late?

      A wrongful death claim carries a three year statute of limitations – which means  you have three years from the date of death to bring a claim. 

 


 

I was eating at a salad bar and got really sick.  I'm not sure why I got sick.  Do I have a case?

    Potentially.  Restaurants have a responsibility to you, the consumer, for all food-borne illnesses which are caused by the food they serve.  It is often difficult,however, to establish that it was in fact their food that caused your illness and not something else. 

 


My grandma is in a nursing home and I don't think they are taking good care of her.  What can I do legally?

    If the nursing home is in Missouri, we recommend first contacting the Department of Aging, Elder Abuse Hotline at 800.392.0210 and lodging a formal complaint. (If the nursing home is out of state, contact that state's Department of Health, request their elder abuse hotline number, and make the report.)  If there are injuries or illnesses which have been caused as a result of poor care (especially bed sores, etc.) please give us a call. 

 


I purchased a used car from a Springfield auto dealer in AS IS” condition. At the time of sale, it was revealed the car had a bad muffler but could easily be replaced with little expense. I paid $1100.00 cash and dealer financed $1100.00 on his own. I took the car for a safety inspection and it was discovered the whole exhaust system was bad and needed replacing. I took the car for an oil change and it was discovered the car had a bad head gasket with a bad leak and the ignition switch was bad - both needing replacing. I called and tried to resolve the issue of undisclosed mechanical problems with the owner and he refused to help. Can I do anything in order to regain some of these costs, not to mention the disrespect, emotional and financial hardship this has caused?

    Purchasing a vehicle AS IS” means just that.  The exception to this rule would be fraud – a material misrepresentation.  Proving that the issues were known by seller is often a difficult burden to overcome.  You could always try to seek remedy through Small Claims Court. 

 


My credit card company called me up and threatened to throw me in jail if I didn't pay up.  I have them on tape.  Is this legal?

      No; it's a violation of the Fair Debt Collection Practices Act (FDCPA).  Please give  us a call and we'll see if we can help. 

 


My dad is in a nursing home and he had a gash on his head last week.  When I asked about what happened, they wouldn't tell me anything.  What can I do?

My wife was recently inured in a car accident.  After the doctor put her on light duty, her employer would not let her return to work.  Now her boss has threatened to fire her if she doesn’t come back.

    If you can show you have a disability, the employer is required to make reasonable accommodations” for you.  They are not required, however, to create a new position to accommodate your disability. 

     


My husband and I were injured in a rear-end collision when I was 5 months pregnant.  I was unable to get x-rays due to the pregnancy, but I had to have physical therapy.  The insurance company doesn't want to pay now because I wasn't released to continue treatment until over six weeks after the delivery of my baby. Can you help clear the muddy water in our situation?

    You will probably have to file suit if you want full compensation – give  us a call and we'll see if we can help. 

     


I was in a car accident in Springfield two weeks ago.  The other party was at fault.  I can’t seem to get the other insurance company to accept liability and get things paid. My car was totaled and I was injured.  The insurance adjuster has been very rude and just tells me it’s pending” and they haven’t done anything! How long am I supposed to just sit and wait?

    It takes some time to process a claim.  You may help speed the process of settling your property claim by providing the insurance company with repair estimates for your vehicle.  It is not unreasonable to assume that this process could take up to 30 days to complete. 

    As far as your bodily injury claim goes, it is wise to not be impatient about settling too quickly - make sure you are completely healed.
