Medical Malpractice

Welcome to Raleigh Legal Line!

It has been estimated that over 100,000 Americans die every year due to medical errors committed by doctors, nurses, hospitals and other medical care providers. The numbers are higher if you add in deaths from nursing home neglect. This number does not even include those who are injured or crippled by such medical malpractice.

These are injuries, disabilities and deaths that need not have happened and, hence, should not have happened. At Merritt Flebotte, we believe that doctors and hospitals usually are careful in what they do, but when they are not, the results can be disastrous, even deadly, for the patient. And when that happens doctors, hospitals and medical care providers must be held accountable for the suffering they cause.

It is important to remember that many times bad things happen to patients during the course of medical treatment without any doctor or nurse being negligent. Just because a medical outcome is bad or someone ends up worse off or dies does not necessarily mean there is a basis for a lawsuit against the medical care provider who cared for the patient or performed the procedure.

Unfortunately, when medical malpractice does happen and someone is hurt or killed it is often hard for the patient or those who loved the patient to know this. The medical community seldom confesses its members’ mistakes to the patient or their family. Often the medical community closes ranks to protect the doctor or nurse who injured or killed the patient. So, unless someone who knows medicine investigates the matter, it is hard for regular folks to know if the doctor or hospital did something wrong. They need help. We have been helping folks injured by medical malpractice or the families of those killed by such malpractice for over 20 years.

It is important to remember that it is hard to win a medical malpractice case. The tremendous resources of the medical profession and their insurers are always brought to bear on the patient or his family. Often times, the patient is thereby victimized twice. Our law firm has the experience and the resources to meet the medical community and their insurers on their own terms.

At Merritt Flebotte, we have several attorneys who are skilled and experienced in handling all types of medical malpractice cases and who are anxious to help you. We have the resources and access to the medical community necessary to properly investigate and prosecute the most difficult of medical malpractice cases.

If you have a potential medical malpractice claim, the first thing we will ask you to do is to write out everything that you or your loved ones remember about the incident and provide us with a complete set of medical records created at the time of the incident. After we review the narrative and the records, we will next have the package reviewed by a Board-certified medical expert. If the attorney and the medical expert agree there is a case of medical malpractices, a claim is made on your behalf. If the claim is denied, we will file suit and the litigation begins. Remember, the time in which you may file a claim is limited.

In medical malpractice claims the power and wealth of the medical community and their insurers make for long odds for the patient seeking justice. We truly enjoy evening those odds for our clients. We do this by bringing the resources of our regional law firm with over 50 lawyers and hundreds of years of combined legal experience in helping people to your case and put the weight of our history, who we are and our commitment to justice on your side. This is what we mean by evening the odds for you. We are always here when you need us. Simply call. Doing what’s right for those who have been wronged is what we do. You can count on us.

I had eight surgeries and spent a month in the hospital to have the infection drained out of my face. I was under the impression that an abscessed tooth had to be treated before it could be removed. I have had no luck finding legal help. No attorney will talk to me. The statute of limitations is running out and I would like to know what I can do.
