Life is full of surprises. At times the unexpected happens and regardless how hard you work, things don’t always work out quite the way you expected.  Loss of employment, a home here in Nashville that is decreasing in value, mounting bills and/or other personal issues may be causing you to consider bankruptcy protection.  This can obviously be very stressful.  At times you may feel there is simply no other way out.

For some people faced with such problems, bankruptcy protection may be an answer.  If you’re considering declaring bankruptcy in the state of Tennessee, you should consider contacting an experienced bankruptcy attorney.   Over the years there have been many changes to bankruptcy laws.   Like any major decision, it’s critical that you arm yourself with all the facts before making any decision.

Many consider the federal bankruptcy code to be far too complex without the advice and guidance of a bankruptcy lawyer.   Bankruptcy attorneys can make sure that you are given all possible options - and that you are shown the proper way of achieving freedom from your mounting debt.  Personal bankruptcy can happen in many instances.  No matter how the situation may have developed, this situation is usually considered a last resort.  You should also know that bankruptcy does not get rid of all debts.  Areas of exclusion can include child support or student loans.

Under no circumstances should you allow yourself to feel rushed – or pushed into making a decision that could affect you and your credit record for years to come.   Impact to your credit can be long lasting.  Some credit reports will have the knowledge that you declared on file for up to ten years.  How does that affect you?  It can make things complicated should you be looking for financing in the future. If you are able to obtain a credit card, or finance for a new home, you may find that your are facing higher interest rates than you have been accustomed to in the past.  This can also interfere with not just credit card companies and home loans but with other organizations and companies (home insurance, life insurance and even getting a job).  These are all good reasons why you should consult with a registered Tennessee bankruptcy attorney when considering the move to bankruptcy.

Everybody filing should be properly informed about the different kinds of Chapters that they can file under.  Find out more about bankruptcy and how it can affect you.  Learn about the various options you have and differences between Chapter 7 and Chapter 13.

For additional help, you can email your bankruptcy question in the box on the right.   Your question will be forwarded to someone who may be able to help.

  • My husband has had a knee replacement, has diabetes, and hypertension. He is unemployed. I work for a nonprofit agency and make a very low wage and may not have a job much longer due to cuts in funding. We owe a local Nashville clinic $1800.00 and now have received a letter from an attorney that they are going to file suit against us if we do not pay the FULL amount immediately. They were VERY nasty when I tried to call and talk to them about this. I have lost our car and we just got through doing a modification on our home to lower our payments to keep from losing it. My husband's medications are $700.00 per month. Can they take payments on this or what can I do? Why will they not speak with people about their debt and try to work with me? We filed Chapter 13 bankruptcy years ago and were told we cannot file Chap 7 again until 2012 or I would file immediately. I think my new home agreement say we cannot file any bankruptcy and keep our home. With none of us employed what can they do?
  • Can you or can you refer me to someone to help with a mortgage mod in Nashville for my mother?
  • I tried to work with two of my credit card companies to lower the interest rate to no avail. Two years ago I entered into a deal with a debt settlement company and stopped paying on my credit cards as per their orders. I have been putting almost 700.00 a month into a separate account with them and they were to correspond with the two creditors. I have recently been sued by one company. I went to a case trial management conference in front of a judge. He told me to get a lawyer. I am buying a house with a friend, so I can't do anything to jeopardize my home w/him. The house is now worth less than what we paid. I also am still paying car payments and don't wish to lose that. What do you suggest I do?Also, I got my credit report recently and noticed that the other credit card company said charge off. What does that mean
  • We are looking into remodifying our home loan, or if filing for bankruptcy is a better option. We have some charge offs of credit cards and vehicle loans. Would like to know what are our options.
  • First, husband is out on disability. I have not received money in two years. I have 2 children, age 3 and 1. I am the only one working. We went through a loan modification on my current home through a law group. I was advised with the money paid that my 1st would be modified and 2nd would be forgiven. While they were working my file, I did not pay creditors. We did not want the bank to think we had additional income that could be put towards a home payment. Home modification on 1st took several months. They tell me now on my 2nd, I have to do another modification. Now I have judgments on my credit report and trying to refinance a 2nd home. How can I do this with judgments on my credit report? I also have a probate property due to settle in July, 2010. Please advise my best option.
  • I have received a Petition for Mortgage Foreclosure on my home. It states that I have to file an answer to the Petition with the court and to serve a copy upon plaintiff’s attorney within 20 days of receipt. How do I file an answer to the Petition with the court It is my intention to pay the past due amount and the required attorney fees to reinstate my mortgage to current. • I’m about 27,000 in debt now in unsecured credit cards. Unable to make minimums I am falling behind. I still have a fulltime job but have lost more than half my income commission hourly. My income now barely covers household expenses. So, obviously I can’t cover my C/C payments. I rent and have no assets to sell. I have talked to a Debt Mgmt Co and was advised to file BK. Should I file for Chapter 7 or 13? Can I do it myself or would you recommend an Attorney assisted filing? How complicated is it? How much does a typical filing cost with an Attorney?
  • I was involved in a young marriage about 6 years ago where bad financial decisions were made. I am trying to figure out a way to get the bill collectors off of my rear, but it cost quite a bit of money to even file a bankruptcy with some attorneys here in Nashville. Can you help me find an affordable attorney that will genuinely help with my issue. It is very embarrassing as it is to be in this situation, and even more humilitating to have to lay it out on someone's desk to ask for the help.
  • I have about 23,000 in credit card debt, I am short selling one property, I still have another, but Im barely making it. I am a student and a personal trainer, my income is about 36k a year. I need help. Should I go to a credit card debt consolidater, or file ch.13? I would love to come and talk with someone.
  • I was in a debt consolidation program when I was laid off from work. I managed to make few of my payments but defaulted on my agreement. I was able to find temporary employment and I was attempting to work directly with my creditors when my prior tax issues - federal & state blew up. I stopped paying the credit card, made arrangements with the federal tax. State is garnishing my wages and I’m working with them on an agreement, paid my credit union loan in full, and currently 2 months away from paying off my 6yr car note. One creditor has obtained a judgment, I was served by another recently, letters from others about to do the same. I own nothing, my temporary job ends this July and I cant see a way out. I inquired about bankruptcy and was told that I could be reprimanded by the courts for furious filling due to income vs. debt however the tax debt cannot be considered at all, not even when showing the courts how I am struggling to make basic life expenses. I am completely lost and overwhelmed. Any direction you can provide may at least give me some hope, because now I have none.
  • Both of my monthly payments on credit card interest are too high at $602. & 23%. I asked the bank to reduce it but to no avail. Is there any way to get this done?
  • We can't claim bankruptcy until April. I have a creditor calling telling me that if I dont pay they will garnish my husbands wages. I can only make a 5.00 payment a month thats all I can afford. Is there anything they can do even though Im sending them just that. Please let me know. He keeps threatening me.
  • I need help to declare bankruptcy. Please contact me.
  • I am moving and breaking a 1 year lease, 6 months early. My landlord wants 4 1/2 months paid totaling $6300.00. The reason I’m moving is the bank is working with our modification and we are recovering our rental home after thinking we had lost it. Does she have a right to ask for 4 1/2 months of rent? I told her we don't have that money and she wants post-dated checks.
  • I need to file bankruptcy. Is there a way to file for free and if not, how much will it cost me?
  • I am 2 months behind credit card payments. 30k in c/c debt, no equity in my home to borrow on, unemployed for 17 months $880/month. Wife just went on sdi on and I am flat broke. We cannot pay our mortgage so bank will start foreclosure. What can we do? Our temporary income is roughly $2400 a month with a house payment on $2050 a month. We are drowning. What are our options? Please help.
  • Every since the Obama stimulus came out for reducing mortgage rates, we have asked out loan company to send us information to apply. They have lied to us and keep giving us different answers. We started asking in July. They just won't even try. Is there anything we can do, or turn them into anyone? We keep reading that only a few have taken advantage of this, I'm thinking because the mortgage companies won't cooperate.
  • Back in march I signed up with a local legal firm to handle our bankruptcy. On our initial visit, we were told that we qualified for chapter 7. I paid them their fee of 2400.00. We were told that we must send them my paystubs weekly, which we did. They also notified us that we should discontinue making our credit card payments, and just have our creditors talk to them directly. In April, I received a 4500.00 bonus from my company. I sent this firm a copy of that stub. As the months went by , my case was never settled and my creditors were threatening me with legal action if my case wasn’t settled soon. I made numerous calls to them and was told I needed to furnish them more documents, which I did. Finally in Oct. , now almost 8 months later, I was informed that we now didn’t qualify for bankruptcy because of my bonus. They still kept my payment for ‘work rendered’, plus now I havent made any payments for 9 months. I am worse off than before. Does this sound right to you?
