A lot of people are struggling these days to find employment.  It is speculated that the unemployment rate may go down sooner in the future, but until then we are all still trying to find work.  Basically there are standard laws that protect you when applying for a job.  Discrimination of any kind is not allowed when the process of hiring is going on.  Age, race, disability, ethnic background, religion or national origins are all part of these.  At anytime if you feel discriminated at because of where you are from or how old you are then you have a right to complain.  Discrimination in the work place can be more common than you know.  If you know that you have been treated in this way than what better way to see what your rights are by consulting an attorney.

Employment law also goes into a whole gamut of other areas.  If at any moment you have felt harassed and told that it would affect your position in the company than you have the right to go forward and complain.  Harassment at work can come in many forms.  Sexual harassment can occur when the employee feels very uncomfortable both physically and mentally.  Nobody should have to feel sexually obligated to keep his or her job.  That has nothing to do with your job in the first place.  Racial discrimination in the work place can be common as well.  A lot of big companies will have employees from all walks of life.  If an employee feels racially discriminated against, and has not seen any action taken, then a case may be taken.  Especially if the harassment continues after a period of time and nothing is done.  Your rights as a worker give you full discretion when being interviewed and working.  A potential employee cannot be denied just because of the age gap.  A restaurant only hires employees that are on the younger side because that is what the employer likes.  That restaurant already has violated that law and may end up being investigated.

The thing about employment law though is that all things said and done (physically and mentally) must be recorded.  Discrimination and harassment are against the law, but proving it can be tricky.  That is why it is advised that you make a complaint of discrimination and harassment the minute you feel it is starting to begin.  Often victims of this can sometimes let it go on for a long period of time.  If you prevent anything early then you might avoid any confrontation at all.  If you let this go on for a long period of time than you may be at even worse risk.  Mental and physical anguish can tear a person down from the inside.  Write down everything and detail it so that you may record it thoroughly.  Dates, times and witnesses to your situation are key.  Has this happened to anybody else in your work environment?  If so talk to them and write down what they may have said as well.

In an economy today where everybody may be working harder than they want to, to get by, nobody should ever have to endure the pain of being harassed or discriminated against.  A work environment must be a place a certain safety and without any persecution.  If you ever feel that these things have happened to you, and that you want to discuss whether you have been treated unfairly, then talk to you local Tennessee attorney and see if you qualify.  Nobody should ever feel like they don’t belong for the wrong reasons.

  • My Nashville employer just posted when we can go to the restroom and to restrict our liquid intake. Is there some labor standard that this falls under in the state of Tennessee? They said no exceptions to the scheduled bathroom breaks. What if someone has diarrhea? I find this completely irrational and unnecessary.

This year I have refereed at the college on four different dates and have not been paid. I spoke to the business office and was told that I have a balance due and that they don’t practice paying someone when there is a balance. Is there anything I can do to recover my pay?
  • After seven years employment I was terminated for a cash shortage. Other employees in my same situation were transferred to noncash positions, whereas I was terminated. I was an exceptional employee and recently employee of the month. My employer says I am eligible for rehire in a non cash position. Can they do this? Is it legal?
  • During a group meeting at work the human resource manager and our team went over policies like phone use and Internet use. After reviewing the policies, we were asked to initial recognizing that we understand the policy. Recently, people had their phone records reviewed in the policy and were suspended. The HR manager stated that the policy acknowledgment we signed was also our verbal and written warning. It does not state anywhere that it is our verbal and written warning. Can a company do this? Any information would be appreciated.
  • I have some concerns about the reason I was fired from my job, as my position was filled with someone in the agency. Two other people were also fired a short time later and positions were also filled within the agency. I also had just received my year review and it was great.
  • I have questions regarding harassment and wrongful termination in the workplace. I am currently still employed at this facility, however, I am feeling harassed by my superiors, threatened on an almost daily basis. I have been suspended without just cause; I have been given a different 2 day suspension without pay for an offense that was clearly not indicated in the documentation provided to me (which is under grievance according to the labor contract at this facility). I feel that management is cohersing my coworkers, and are "digging" for things in an attempt to fire me. How should I handle this situation? My union representative is and has been involved and he feels much the same was as I do.
  • If I get a write-up at work and refuse to sign it what could happen? What are my options if I do not agree with it?
  • I was recently terminated from an employer due to what they claim was harassment and misconduct. I am in the process of filing for unemployment insurance which was denied due to the employers statements. I have most recently filed an appeal. I have recently contacted my employer as my right to do so to request a copy of my employee file to substantiate their claims since the day I got fired they mentioned nothing of harassment, etc. They have since refused to forward me a copy of my file. Is this legal?
  • My spouse just informed me that because she missed a work meeting earlier this year - she now has to make up the equivalant time watching education videos pertaining to her occupation. The videos have to be watched off the clock at the work facility. She has until the end of the year or they told her they will be required to fire her then re-hire her at minimum wage. She would lose her accumulated vacation and wages that she has earned over the last 3 years of employment. This just doesnt add up to me. What do you think?
  • I recently was fired after going on disability. I was put on disability because I had an unknown anxiety condition triggered by mandatory pepperspray training for my job. They gave me time off to get better and wouldn't let me back until I had a doctor's note. The doctor put me on disability and the next day I was fired. What should I do I don't want to work for them after they did that, but I feel wronged.

  • I'm inquiring about job harassment on behalf of my mother. Her employer wants her to quit. The employer has told her she will not fire my mother because the employer has stated that she will not pay unemployment to my mother if she fires her. Now my mother is getting harassed by the employer to the point of a physical breakdown. What can be done about a situation like this?
  • I'm a superintendent working in construction. I have been given days off due to slow times while others have been kept busy. But my question is I believe that I am a exempt employee and that my employer does not have the right to not pay me because i'ts slow. Ive niether been layed off or fired. I'm in limbo.
  • I was hired as a Sales Manager for a small advertising firm. My pay was to be based on hiring a crew of 15 sales reps, training them on our policies and procedures and for each rep that would reach their min weekly quota I would receive $150/week. I was informed after I accepted the position that the company was in the process of getting additional loans to fund the company. Basically the company had no money at the time and was trying to secure loans to cover the overhead. I was apprehensive of continuing but being named the Sales Manager was an amazing opportunity for me to prove how well I could run my own department. Approx. one week after I started our VP of operations was killed and the business was sent in a downward spiral. Many of the day to day activities such as writing the policies and procedures for the business were placed in my lap as well as my sales manager duties. To make a long story short a large part of the work I was doing was not what I was hired for which took away from my ability to hire a sales team as well as meet my sales requirements. In the seven months I have worked with the company there were a total of three to four sales made none of which I made. Also the loans never came and I was unable to hire a sales team due to the fact that no one I interviewed wanted to work a commission only position. Five months into working for the company I was on the verge of closing a fairly large deal which could have really jump started the business. Needless to say the deal did not go through and we were back at stage one again. My boss came to me a few weeks later and asked if I wanted to leave the company to find a job that paid and that when he got the company on its feet he would bring me back. He also informed me that if I wanted to stay he would pay me $250.00 per week to call 50 prospective clients, inform them of our business and ask permission to send them an email of what we could offer them. I was to make the list of those who I contacted and email it to him daily. He would then in turn call them, set up meetings and sell them on our advertising. He stated that I did not have to sell at all. All I had to do was call them, get permission to email them some information and then forward the contact info to him. For four weeks I did just that. It has been three weeks to a month and my boss has not made any sales. He has agreed to write a contract to pay me my $1000 but Im not sure he will actually pay me. At this time he is requesting I return the laptop computer that was given to me for the purpose of working when I was not in the office. I am afraid that if I return the computer I will never see a cent of the money he says he will pay me and if I do, it wont be for years. Do I have the right to hold the computer as collateral until I receive the money that was promised or do I have to return the computer and take him to court to get the money that he agreed to pay me?
  • After the completion of a delivery for a Nashville company I worked for. They decided to not pay me. I was informed that because the contractor did not pay them, I could not get paid. How can I find out if this is true
